ha pronunciato la presente
ORDINANZA
sul ricorso numero di registro generale 3614 del 2012, proposto da:
Associazione Italia Nostra Onlus – Associazione Nazionale Tutela Patrimonio Storico, Artistico e Naturale della Nazione, rappresentata e difesa dagli avv. Oreste Cantillo, Oreste Agosto, con domicilio eletto presso Associazione Italia Nostra Onlus in Roma, viale Liegi, 33;
contro
Comune di Salerno, rappresentato e difeso dall’avv. Antonio Brancaccio, con domicilio eletto presso Antonio Brancaccio in Roma, via Taranto, 18; Crescent Srl, rappresentata e difesa dagli avv. Mario Sanino, Lorenzo Lentini, Paolo Vosa, con domicilio eletto presso Mario Sanino in Roma, viale Parioli, 180;
per la riforma
della sentenza del T.A.R. CAMPANIA – SEZ. STACCATA DI SALERNO: SEZIONE I n. 01770/2011, resa tra le parti, concernente PERMESSO DI COSTRUIRE
Visti il ricorso in appello e i relativi allegati;
Visto l’art. 98 cod. proc. amm.;
Visti gli atti di costituzione in giudizio di Comune di Salerno e di Crescent Srl;
Viste le memorie difensive;
Visti tutti gli atti della causa;
Vista la domanda di sospensione dell’efficacia della sentenza del Tribunale amministrativo regionale di reiezione del ricorso di primo grado, presentata in via incidentale dalla parte appellante;
Relatore nella camera di consiglio del giorno 5 giugno 2012 il Cons. Giuseppe Castiglia e uditi per le parti gli avvocati Oreste Agosto, Moreno Pacifici in sostituzione di Oreste Cantillo, Antonio Brancaccio, Lorenzo Lentini, Mario Sanino e Paolo Vosa;
Tenuto conto dell’esigenza di rimettere al merito la compiuta valutazione delle complesse questioni implicate dalla controversia e, in primo luogo, la definizione dei profili processuali posti a fondamento della sentenza di primo grado;
ritenuta l’opportunità di evitare che la prosecuzione dei lavori per la realizzazione di un edificio di cospicue dimensioni, in una situazione controversa, produca una trasformazione dello stato dei luoghi difficilmente reversibile e tale da determinare per la collettività un pregiudizio grave e irreparabile; ciò, sia per le trasformazioni materiali da operarsi, sia anche alla luce dell’art. 2, lettera G), del contratto stipulato tra il Comune di Salerno e la Crescent s.r.l., per effetto del quale il rischio proprio degli esiti delle azioni giudiziarie pendenti in relazione all’immobile è assunto dalla parte pubblica;
considerato che l’interesse dell’Associazione appellante può essere soddisfatto mediante una sollecita discussione della causa nel merito;
considerato inoltre che, nei limiti della sommaria tutela cautelare, l’appello in esame sembra presentare profili di connessione con quello di cui al ricorso n. 3609/2012, assegnato ad altra Sezione;
ritenuto che, tenendo conto della complessità della vicenda, sussistono giustificati motivi per compensare tra le parti le spese del presente giudizio cautelare;
P.Q.M.
Il Consiglio di Stato in sede giurisdizionale (Sezione Quarta) accoglie l’istanza cautelare (Ricorso numero: 3614/2012) nei sensi di cui in motivazione e, per l’effetto, sospende l’esecutività della sentenza impugnata.
Manda alla segreteria di comunicare la presente ordinanza anche all’ufficio del Presidente del Consiglio di Stato affinché questi valuti, ove lo ritenga opportuno, i profili di connessione di cui in motivazione.
Compensa le spese della presente fase cautelare.
La presente ordinanza sarà eseguita dall’Amministrazione ed è depositata presso la segreteria della Sezione che provvederà a darne comunicazione alle parti.
