DIMINUISCE IL NUMERO DEI COMPONENTI DELLA COMMISSIONE

MA AUMENTA L’IMPORTO DEI GETTONI

La Regione Campania con la deliberazione di Giunta Regionale n.449 del 12/07/2017, pubblicata sul BURC del 07.08.2017 n.62, ha riformato il sistema della formazione professionale approvando un disciplinare per lo svolgimento degli esami finali per i corsi finanziati ed autofinanziati, in allegato, che esclude dalle Commissioni esaminatrici gli esperti designati dalle amministrazioni periferiche del Ministero della Pubblica Istruzione e del Ministero del Lavoro, diversamente da quanto previsto dall’art.14 della Legge 845/78, i cui vincoli non sarebbero più vigenti a seguito della legge costituzionale n. 3 del 18.10.2001, che, recando modifiche al titolo V della parte II della Costituzione, ha affidato alle Regioni competenza esclusiva in materia di formazione professionale (art.117, comma 3, Cost.), fermo restando ovviamente la competenza dello Stato in materia di definizione dei Livelli Essenziali delle Prestazioni.

 

In attuazione della delibera di Giunta regionale, di recente, sul Burc Campania del 16 ottobre 2017, sono stati pubblicati gli avvisi per manifestazione di interesse per la costituzione di esperti del settore economico professionale (SEP) e per la costituzione di elenchi di Presidenti e Segretari di Commissioni d’esame, che devono essere esclusivamente dipendenti incardinati nell’ente regionale.

 

Tutto bello, a nostro avviso, se la riforma del sistema di formazione professionale regionale della Campania si ponesse come unica e reale finalità, così come in altri sistemi regionali italiani, la diminuzione dei costi che gravano sulle agenzie formative (e che poi inevitabilmente ricadono sui partecipanti), l’innalzamento del livello qualitativo delle commissioni istituite dalla Regione, lo snellimento dei procedimenti etc.

 

Ma, è cosi? Sembra di no perché, la Regione Campania, se, da un lato, ha diminuito il numero dei membri della Commissione per il rilascio di qualifica professionale, escludendo gli esperti ministeriali del Lavoro e della Pubblica Istruzione, dall’altro, ha aumentato l’importo dei gettoni per i restanti componenti, che passano da 51,60 euro lordi (come previsto dalla Delibera di G. R. n.6547 dell’11 ottobre 1994) a 100,00 euro lordi per i componenti con funzioni di Presidente (dipendente regionale) o di Esperto di SEP e di 80,00 euro lordi per il componente con funzioni di Segretario (dipendente regionale).

 

Inoltre, non è possibile, a nostro giudizio, innalzare il livello qualitativo della Commissione escludendo proprio gli esperti, componente terza rispetto all’Ente regionale.

 

Ma vi è di più. Domanda: se la Regione ha competenza esclusiva in materia di formazione professionale (ivi compreso il monitoraggio, la vigilanza e la verifica dell’attuazione e della gestione della offerta formativa dei corsi) è possibile che i dirigenti e funzionari dell’assessorato regionale alla Formazione professionale, per svolgere una funzione istituzionale (quando vanno a presiedere le commissioni d’esame alla fine dei corsi di formazione) incassino soldi dai titolari di enti e società di questo settore, sia con riferimento ai corsi di formazione finanziati con fondi pubblici, sia con riferimento ai corsi organizzati e gestiti con fondi privati? Non vi è un conflitto di interessi?

 

I dirigenti e i funzionari dell’assessorato regionale alla Formazione professionale, che vanno a presiedere, come componenti interni dell’Ente competente, gli esami, svolgono o no una funzione istituzionale per la quale sono già pagati dall’Amministrazione Regionale?

 

In base a quale norma di legge o previsione del contratto collettivo di riferimento, gli enti e le società che operano nel mondo della Formazione professionale della Campania debbono pagare un gettone di presenza ai dirigenti e i funzionari regionali per lo svolgimento di una funzione istituzionale?

 

La disciplina del trattamento economico fondamentale accessorio del dipendente pubblico non è definito esclusivamente dai contratti collettivi (ai sensi dell’art.45, comma 1, del TUPI) e qualsiasi disposizione regionale (regolamento) che riconoscesse somme aggiuntive al dipendente travalicherebbe la competenza esclusiva statale, in materia di ordinamento civile, ponendosi anche in contrasto con le attuali misure di prevenzione della corruzione?

 

In tutto questo l’Ispettorato del Lavoro cosa fa: resta a guardare?
