qualche brutta notizia dall’ONU dove alcuni paesi stanno facendo pressione per togliere il “riconoscimento del diritto all’acqua e ai serivizi sanitari” dall’outcome document di Rio+20.
Continua il “colpo di mano” che abbiamo visto a Marsiglia al Forum Mondiale dell’acqua (WWF): “negare” la risoluzione dell’Assemblea Generale delle Nazioni Unite (UNGA) sul diritto all’acqua. Stavolta si vuol tentare il colpo non entro il WWF (illegittimo e non certo fonte di diritto internazionale) ma entro un processo dell’ONU medesima, ossia la conferenza di Rio (UNCSD).
Fra i gruppi di paesi “cattivi” fino a stamani c’era anche la UE (Italia compresa, dunque), ma adesso l’UE ha deciso di rinunciare, ben comprendendo quanto sia divenuto ormai insostenibile tenere ufficialmente una posizione anti-diritto all’acqua, almeno sul piano formale, cercando di depotenziare il voto UNGA 2010.
Sarebbe comunque utile inviare lo stesso un fax alle delegazioni di Germania e Spagna, oltre a quella dell’Italia. Stiamo infatti cercando di coordinare globalmente un fax-bombing da parte delle varie organizzazioni mondiali.
In particolare dovremmo inviare fax almeno a Canada, Regno Unito, Nuova Zelanda, Australia e USA (che stanno spingendo per un linguaggio più debole, di fatto una negazione della risoluzione UNGA 2010). In allegato la lista dei numeri cui inviare i fax. Sotto vi giro il testo con cui Anil (che sta seguendo a New York la situazione per tutt* noi) ci aggiorna sullo stato delle cose (mail in inglese con traduzione in spagnolo) ed elenca in modo preciso i paesi a rischio.
In fondo trovate anche il testo della lettera da inviare via FAX ( testo in inglese e in spagnolo). La preghiera è che questo non sia fatto solo da noi come “Forum Italiano dei Movimenti per l’Acqua” ma anche da tutte le singole organizzazioni che adersicono al Forum e possibilmente da tutte le organizzazioni che hanno preso parte al percorso referendario, riconoscendosi nel percorso internazionale per il riconoscimento del diritto all’acqua e ai servizi igienico sanitari di base.
Here is the latest update from the Rio+20 negotiations in New York on the campaign to save the human right to water and sanitation.
The EU has backed down, for the moment, but now we must increase our pressure and be even more strategic.
See my analysis below, but I am asking for organizations to fax a letter into strategic missions at the UN in New York, phone if you cannot fax.
The danger now is that despite the EU’s retreat, the signal to attack water has been given and other states join Canada, New Zealand and the UK against the human right to water and sanitation. Denmark is still also a target as EU chair and for their historic position on the right to water.
At around 11am this morning in New York water will be negotiated so we need to apply pressure! I will try and tweet what happens @anilnaidoo
I am advising that we target those few countries who are outwardly against or been in the past and will be considering their positions.

I have removed those with the Group of 77 countries (who, on the whole thanks to leadership from a few, need to be commended for standing up for the human right to water)
Also have not targeted other EU countries – though would be good to pressure those past good states within the EU, Germany and Spain in particular, who have not been strong this time which I believe has allowed the UK to dictate the position, supported by the Danish chair.
Canada, by far, has taken the most aggressive stand of any country against the right, but the Conservative government in Canada is a continuing major barrier to many positive international efforts, please do target them!
Finally, here is a little more background that might be of interest.
At the end of the negotiations late last night (March 20th) my contacts inside the European Union confirmed that the EU has withdrawn its amendment in paragraph 67 which called for removing the human right to water and sanitation.
They will be silent when the text is negotiated later this morning, again, probably around 11am Eastern time in New York.
While this is very good news, it only buys us a bit more breathing room.
This is because the EU’s ‘mistake’ has signalled to other countries that it is acceptable to attack the human right to water and sanitation.
Yes, the implausible claim by the EU is that this text was because of a ‘mistake’ by the UN secretariat, but at the same time my contacts are also clear, the EU could reintroduce text if there is an opening or momentum.
This is why we need to keep the pressure on states or we will lose the human right to water and sanitation, not only from this text, but effectively from all future international negotiations as what happens here will set a precedent.
Finally, here is a list to consider… of the 42 original countries that abstained from the General Assembly resolution, most have since supported in one place or another… here are those that we have no record of supporting since that vote in July 2010. I suggest we consider them all as opponents or at risk!

Seeking to protect the United Nations historic recognition of the Human Right to water and Sanitation by the General Assembly and Human Rights Council through resolutions A/Res/64/292 and A/HRC/15/L/14 respectively,
Concerned by amendments to the UNCSD Zero Draft text which seeks to remove recognition of the Human Right to Water and Sanitation,
Call upon all UN Member States to respect their legally-binding obligations to respect, protect and fulfill the Human Right to Water and Sanitation as embodied in the two cited resolutions, the UN Declaration of Human Rights, the Convenant on Economic, Social and Cultural Rights, the Convenant on Civil and Political Rights and all other relevant international laws, treaties, covenants or declarations,
We further demand that the negotiations for Rio+20 and the proposed Green Economy not lead to increased violations of the Human Right to Water and Sanitation through the introduction of mechanisms designed to implement markets, property rights and trading regimes for water.
We call upon all UN Member States to work with civil society and social movements to create the water ‘Future We Want’ which must include respect for water as a human right, public trust and commons.

Esta es la última actualización de las negociaciones de Río +20 en Nueva York en la campaña para salvar el derecho humano al agua y al saneamiento.

He quitado las personas con el Grupo de los 77 países (que, en general gracias al liderazgo de unos pocos, hay que elogiar por defender el derecho humano al agua)
Además, no se han dirigido a otros países de la UE – aunque sería bueno para presionar a los buenos estados pasados dentro de la UE, Alemania y España en particular, que no han sido fuertes este momento que creo que ha permitido que el Reino Unido, a dictar la posición, apoyada por el presidente danés.
Canadá, por el momento, ha adoptado la postura más agresiva de cualquier país en contra de la razón, pero el gobierno conservador de Canadá es una barrera importante y persistente de muchos de los esfuerzos internacionales positivos, por favor dirigirse a ellos!
Finalmente, aquí está un poco más de fondo que podrían ser de su interés.
Al final de las negociaciones de anoche (20 de marzo) mis contactos dentro de la Unión Europea confirmó que la UE ha retirado su enmienda en el párrafo 67, que llama para eliminar el derecho humano al agua y al saneamiento.
Ellos estarán en silencio cuando el texto se negocia más tarde esta mañana, de nuevo, probablemente en torno a las 11am hora del Este de Nueva York.
Si bien esta es una muy buena noticia, sólo nos compra la habitación de un poco más la respiración.
Esto se debe a la UE “error” ha señalado a otros países que es aceptable para atacar el derecho humano al agua y al saneamiento.
Sí, la afirmación de inverosímil por la UE es que este texto fue debido a un “error” de la secretaría de la ONU, pero al mismo tiempo que mis contactos también son claras, la UE podría reintroducir el texto si no hay una abertura o velocidad.
Es por eso que tenemos que mantener la presión sobre los estados o vamos a perder el derecho humano al agua y saneamiento, no sólo de este texto, pero de manera efectiva de todas las futuras negociaciones internacionales, como lo que sucede aquí sentará un precedente.
Finalmente, aquí está una lista de considerar … de los 42 países originales que se abstuvieron en la resolución de la Asamblea General de la mayoría, ya han apoyado en un lugar u otro … aquí están los que no tenemos ningún registro de apoyar ya que el voto en julio de 2010. Sugiero que los considera a todos como opositores o en riesgo!

Hacemos un llamamiento a todos los Estados miembros de la ONU a respetar sus obligaciones jurídicamente vinculantes de respetar, proteger y garantizar el Derecho Humano al Agua y al Saneamiento consagrado en las dos resoluciones citadas, la Declaración Universal de los Derechos Humanos, el Pacto sobre Derechos Económicos, Sociales y Culturales , el Pacto sobre Derechos Civiles y Políticos y todas las otras leyes internacionales pertinentes, tratados, pactos o declaraciones,
Exigimos que no las negociaciones para Río +20 y la economía verde propuesto llevar a un aumento de violaciónes del derecho humano al agua y saneamiento a través de la introducción de mecanismos destinados a poner en práctica los mercados, derechos de propiedad y los regímenes de comercio para el agua.
Hacemos un llamamiento a todos los Estados miembros de la ONU para trabajar con la sociedad civil y los movimientos sociales para crear “el futuro que queremos” el agua que debe incluir el respeto por el agua como un derecho humano, la confianza del público y los bienes comunes.
